Abstract

Marie St. Cyr, the widow of Valerien Bergeron Sr., seeks to settle her late husband's estate. Marie St. Cyr and Valerien Bergeron married in 1815, each bringing property into the marriage by prenuptial agreement. Bergeron brought two slaves, now dead, and a tract of land. During their marriage, the couple garnered more property, including at least thirty-nine slaves, which became community property. Bergeron died in January 1861 and Marie asserts that she "is entitled to the usufruct of all the said Community property during her life time." The couple's eleven children are entitled to "the said tract of land brought in marriage" by their father. St. Cyr has settled the estate with most of her children, but three of her daughters and their husbands refuse to settle and instead "pretend to claim all the property above mentioned as belonging to said heirs." St. Cyr prays that all her children and their spouses be made defendants to this bill and that the court determine the appropriate distribution of the succession.
