Lucy Stewart and her husband, John A. Dougherty, seek a division of an estate to which they are heirs. The late Nolan Stewart died after having published two official wills, one in October 1853 and one in 1854, both of which have been probated. In the wills, the petitioners along with Alfred A. Williams and his wife, Catharine Stewart, were named heirs to "the whole of his estate both real and personal." By the second will, Williams was named "sole testamentary executor." Catharine has since died, leaving three minor heirs, who should now inherit her interest in the estate. The petitioners pray that the court order a division of the Stewart estate.
