Abstract

John Drayton, "Esquire Governor of the State" of South Carolina, joins his wife, Hester Rose, in seeking permission from the court to sell real estate belonging to Hester Rose's trust estate. The real estate, derived from the estate of Hester Rose's father, the late Philip Tidyman, is subject to conditions in the couple's marriage agreement. Hugh Rose, Hester's trustee, refuses to consent to the sale "without the sanction of this Honorable Court." The petitioners propose to use the proceeds generated by the sale to purchase slaves.
