Abstract

When John and Elizabeth Latham married, they entered into an agreement whereby each would retain their own property and Elizabeth's estate, which included ten slaves, would be placed into a trust. Later, however, she decided to sell Keziah, a female slave who repeatedly ran away and demonstrated "a thievish disposition." With her verbal consent, John Latham sold Keziah "to a person residing in the State of Georgia who was in this Country purchasing negroes to remove to the place of his residence." He then bought another slave, Mary, but the bill of sale "was in his own name instead of the names of your Orators William and John to whom Keziah the woman sold as aforesaid was convey'd in Trust." When one of John Latham's creditors "sued out an Execution against the goods & Chattels of your Orator John the husband of your Oratrix," the sheriff seized Mary and "the said negro woman altho in Equity and Justice the property of your Orators William & John as Trustees for your Oratrix will be sold to satisfy the said Execution issued for a debt contracted by your Orator John the husband of your Oratrix." The petitioners pray to stay "further proceedings."
