Horatio Offutt alleges that George Carter deceived him on the sale of a slave. Carter sold Ben for $500, promising Offutt that the slave was "sound, healthy, & entirely clear of any sickness, disease or complaint whatsoever." Offutt claims, however, that Ben was "unhealthy, unsound & afflicted with a certain chronic disease called the dropsy, or some other fatal & incurable complaint," a fact that Carter hid from him with the intent of defrauding him. Ben is near death and useless to the plaintiff. Offutt sues Carter for $1,000 in damages.
