George R. Fairbanks seeks to foreclose on a bond for $10, 896.73 executed by Joseph M. Hernandez, and secured by forty-two mortgaged slaves. Fairbanks represents that Hernandez negotiated the bond with the executors of the estate of the late Joseph Hunter with the understanding that Hernandez would make biannual payments towards the principle. The petitioner represents that the defendant has paid "no part of the said principle sum of money" to which he is now entitled.
