Abstract

James Deloach claims that he owns "certain negro slaves"--Dave and Suckey--jointly with Greenberry Hildreth, and others, including two minors. Deloach is desirous to have the joint property divided and his share set apart. However, the slaves cannot be equitably divided in kind; therefore Deloach asks permission to sell the slaves and divide the proceeds among the joint owners. Furthermore, he explains, the slaves are "in the decline of life and would Command a better price at this time than at any Subsequent period." The related register's report reveals that the slaves are sold at auction in 1849 and that Mabel or Mabeleel Hildreth, one of the minors who jointly owned the slaves with Deloach, purchased both of them. Mabel Hildreth is referred to as "he" in the register's report; therefore the gender of that person cannot be ascertained from the documents.
