In 1849, Joseph E. Caro borrowed $400 from George W. Barkley, securing the notes with a mortgage on the slave woman, Marianne, "and her future issue and increase." Asserting that said notes "have long since become due and payable," Barkley asks the court to "award Judgment on his favor for the amount of the principal sum of money and the interest thereon ... and also to decree that the said Joseph E. Caro, and all persons claiming or to claim by, through or under him, be forever foreclosed and barred of ... equity of redemption in the said mortgaged slave Marianne."
