Abstract

Elizabeth Montgomery, administratrix of the estate of Priscilla Richards, seeks an injunction and subpoena against Ignatius H. Hagan, constable, to prevent him from selling a female slave named Lucy. Hagan has levied a fieri facias against Lucy to satisfy judgments rendered against Leonard Richards, Priscilla's son, who was indebted to Elizabeth Montgomery's husband, James. Montgomery claims that Lucy belongs to Priscilla Richard's estate and explains that she bought Lucy from Leonard Richards before the judgments were rendered against him. In her duties as administratrix, she has disposed of the full amount of Richards's estate, paid off the debts, and claims that Lucy is property that is "not legally liable" for the estate's debts.
