Abstract

John Rudd seeks payment for a debt owed by James H. Scott, a resident of Alabama or Mississippi. Rudd informs the court that "the said James H Scott is entitled to an interest in the Estate of Charles A Scott decd ... which Estate consists of land negroes and other personal property." He asserts "that the portion of the said Estate belonging to the said James H Scott ... will be sufficient to pay your Orators debt interest and costs." The petitioner therefore prays "that your worships will direct and order that the said interest of the said James H Scott in the said Estate of the said Charles A Scott decd thus ascertained and separated shall be sold and out of the money arising from such sale that your worships will decree that your Orators debt of one hundred and one dollars and fifty cents" be paid.

Result: Dismissed by plaintiff.
